These Definitions ("Definitions") apply to the Terms of Use, Privacy Policy, Shipping, Returns & Refund Policy, FAQs, International Privacy & GDPR Notice, and any other legal policies published by GiftDaddy™, unless a specific document expressly provides otherwise.
Capitalized terms used throughout the Platform have the meanings set forth below.
Account
An individual user profile created on the Platform that allows a User to access GiftDaddy services, connect with other Users, purchase GiftDaddy Points, transfer GiftDaddy Points, redeem GiftDaddy Points, manage Orders, and use other Platform features.
Affiliate
Any entity that directly or indirectly controls, is controlled by, or is under common control with Gifty Club, LLC.
Applicable Law
Any federal, state, provincial, territorial, local, or international law, regulation, ordinance, rule, court order, or governmental requirement applicable to the Platform or its Users.
Authorized User
A person who has lawfully created or been granted access to an Account in accordance with the Terms of Use.
Connected User
A Sender or Recipient who has established an authorized connection through a GiftDaddy-approved method, including usernames, invitations, QR codes, or other connection methods introduced by GiftDaddy.
A Connected User relationship may be established only between individuals who have an Existing Relationship.
GiftDaddy does not verify, endorse, or create such relationships.
Customer Support
GiftDaddy personnel or authorized representatives responsible for assisting Users with Accounts, Orders, transactions, shipping, refunds, technical support, or other Platform-related matters.
Existing Relationship
An Existing Relationship means a relationship between two individuals that was established independently of the GiftDaddy Platform.
GiftDaddy does not create, facilitate, broker, recommend, encourage, or introduce relationships between Users.
Users are solely responsible for establishing and maintaining their own relationships before connecting through the Platform.
The Platform exists solely to facilitate the private exchange of gifts between individuals who already know one another.
Fulfillment Partner
Any third-party warehouse, distributor, supplier, logistics provider, shipping carrier, or fulfillment company engaged by GiftDaddy to package, process, or deliver Merchandise.
GiftDaddy
GiftDaddy™, GiftDaddy.com, the Platform, and all related products and services operated by Gifty Club, LLC, unless the context clearly requires otherwise.
GiftDaddy Points
Digital account credits purchased by a Sender and transferred to one or more connected Recipients for redemption toward eligible Merchandise offered through the Platform.
GiftDaddy Points:
- are not cash;
- are not legal tender;
- are not gift cards unless expressly designated by GiftDaddy;
- are not stored monetary value;
- are not cryptocurrency;
- are not securities;
- have no independent cash value; and
- may only be redeemed through functionality authorized by GiftDaddy.
Gifty Club
Gifty Club, LLC, a Missouri limited liability company doing business as GiftDaddy™.
Intellectual Property
All copyrights, trademarks, service marks, logos, trade dress, software, source code, databases, graphics, photographs, videos, illustrations, designs, text, documentation, and other proprietary rights owned or licensed by GiftDaddy.
Merchandise
Products offered for redemption or purchase through the Platform.
Order
A completed transaction through which Merchandise is redeemed using GiftDaddy Points or purchased using another payment method authorized by GiftDaddy.
Personally Identifiable Information (PII)
Information that identifies, relates to, describes, or could reasonably be associated with an identifiable individual, including names, addresses, email addresses, telephone numbers, payment information, online identifiers, and other information protected under applicable privacy laws.
Platform
The GiftDaddy website, mobile applications, software, databases, APIs, communications, ecommerce functionality, and all related technology operated by GiftDaddy.
Privacy Policy
GiftDaddy's Privacy Policy, as amended from time to time.
Recipient
A registered User who receives GiftDaddy Points from one or more Senders and redeems those Points for eligible Merchandise available through the Platform.
Refund
A return of funds approved by GiftDaddy in accordance with the Terms of Use and the Shipping, Returns & Refund Policy.
Sender
A registered User who purchases GiftDaddy Points and transfers those Points to one or more connected Recipients.
Services
All services, software, ecommerce functionality, payment processing, customer support, technology, communications, and related offerings provided by GiftDaddy through the Platform.
Shipping Carrier
Any third-party transportation company engaged to deliver Merchandise to a Recipient.
Terms of Use
GiftDaddy's Terms of Use, together with any amendments or incorporated policies.
Transaction
Any purchase, Point transfer, redemption, Order, shipment, refund, Account activity, or other interaction conducted through the Platform.
User
Any individual who visits, accesses, registers for, or otherwise uses the Platform, regardless of whether that individual creates an Account.
User Content
Any review, rating, photograph, image, comment, suggestion, testimonial, feedback, or other content submitted by a User through the Platform.
Username
The unique identifier selected or assigned to an Account for purposes of identification within the Platform.
Wallet
The portion of a User's Account reflecting the current GiftDaddy Points available for redemption.
The Wallet is informational only and does not constitute:
- a bank account;
- a payment account;
- a stored-value account;
- a deposit account;
- an investment account; or
- any other financial instrument.
Website
The GiftDaddy website located at www.giftdaddy.com, together with any successor domains owned or operated by Gifty Club, LLC.
Interpretation
Unless the context clearly requires otherwise:
- Singular terms include the plural.
- Plural terms include the singular.
- References to one gender include all genders.
- References to "including," "includes," or "include" mean "including without limitation."
- References to "days" mean calendar days unless expressly stated otherwise.
- References to "business days" mean Monday through Friday, excluding recognized United States federal holidays.
- Headings are provided for convenience only and do not affect interpretation of these Definitions or any related policy.
